PTI DATI devices: beware of self-monitoring

Providing in-house security for employees working in isolated situations is an option. But it requires rigorous organization. Failure to take all the necessary measures required by law can cost you dearly. As Le Figaro reports, a multinational was ordered to pay an employee over 60,000 euros in unpaid penalty payments. The employee was required to be on call for the company's needs outside his working hours. This service, which was not provided for in the employee's employment contract, was not subject to financial compensation, hence the Court of Cassation's ruling.

How to manage assistance and PTI DATI devices internally?

Scrupulously identify risks and isolated workers.

There is no exhaustive list of isolated work situations to refer to. Nor is this context reserved for high-risk professions. For this, you can rely on the recommendation of the Caisse Nationale d'Assurance Maladie des Travailleurs Salariés. According to Legifrance: "work is considered isolated when the worker is out of sight or hearing range of other people and without the possibility of outside recourse, and the work is of a dangerous nature."

Set up an effective 24/7 surveillance system.

To self-monitor, you need to define on-call employees dedicated to receiving alerts from your PTI DATI devices. Instructions for each type of alert must be defined. In the event of an alert, your employees' health and safety are at stake, and there's no room for guesswork. You must also guarantee the responsiveness, ability to qualify the alert and contact help of your on-call personnel.
